By securing your enrolment in Project 90, operated by Dulson Performance, you explicitly agree to the following operational terms, conditions, and waivers of liability. Read these terms carefully; they represent a binding agreement between you and Dulson Performance. 1. ELIGIBILITY & AGE RESTRICTION - Project 90 is an elite structural protocol designed strictly for adult participants. By securing your enrolment, you officially confirm and warrant that you are at least 18 years of age at the time of purchase. Verification: Dulson Performance reserves the right to request official photographic identification to verify age prior to the cohort start date or prize allocation. Breach of Eligibility: Any participant found to be under the age of 18 will have their platform access immediately revoked, their competition entry voided, and will forfeit any right to a refund or prize payout. 2. THE DEPLOYMENT FAIL-SAFE (30-PAX MINIMUM) - Project 90 requires a minimum operational deployment of 30 active participants to unlock the £1,600 prize pot. If the 30-participant threshold is not met prior to the official start date, the cohort will be cancelled. In the event of a fail-safe cancellation, all entrants will automatically receive a 100% refund to their original payment method within 5-7 business days. 3. STRICT REFUND POLICY - Outside of the Deployment Fail-safe outlined above, we operate an uncompromising refund policy to protect the integrity of the programme. Pre-Launch Cancellations: If you wish to withdraw before the official September start date, you must email management directly at jonathan@dulsonops.co.uk to request a refund. Administrative fees may apply. Active Cohort: Once the Project 90 clock officially begins, zero refunds will be issued under any circumstances. You are purchasing access to proprietary digital architecture, intellectual property, and a timed competition. Failure to adhere to the programme, utilise the software, or complete the 90 days does not entitle you to a refund. 4. MEDICAL LIABILITY & ASSUMPTION OF RISK -Project 90 provides structural physical programming, but it is not medical advice, nor does it replace the guidance of a registered physician. Assumption of Risk: You acknowledge that physical exercise carries an inherent risk of injury, illness, or aggravation of pre-existing conditions. You voluntarily assume all physical and medical risks associated with participating in this 90-day protocol. Liability Waiver: By enrolling, you unconditionally release, indemnify, and hold harmless Dulson Performance, its founders, and its sub-contractors from any and all liability, claims, or demands for personal injury, medical expenses, or property damage arising out of your participation. Medical Clearance: It is your sole responsibility to ensure you are medically fit to participate. If you have chronic conditions, joint instability, or cardiovascular issues, you must seek clearance from your General Practitioner prior to beginning the programme. 5. PRIZE ALLOCATION & JUDGING METRICS - The £1,600 prize pot and coaching tiers are awarded purely on the basis of physical recomposition and programme adherence. Judging is conducted internally by Dulson Performance management. All decisions are final and not subject to appeal or dispute. To be eligible for the prize pot, participants must complete all mandatory weekly check-ins, data submissions, and provide final comparative photographs as dictated by the platform. 6. DATA SOVEREIGNTY & MEDIA CONSENT - Your biometric data and progress check-ins are hosted securely on our proprietary platform. However, by entering Project 90 and competing for the prize pot, you grant Dulson Performance the right to utilise your final "Before and After" transformation data and anonymous adherence metrics for future architectural case studies and marketing purposes. 7. PLATFORM ARCHITECTURE & CODE OF CONDUCT - Access to the proprietary Dulson Performance Community Platform is a privilege tied directly to your active enrolment. The platform is a clinical, professional environment built for structural tracking and elite community support. By logging into the ecosystem, you agree to the following absolute standards of use: A. Account Sovereignty & Zero Third-Party Access: Your platform access, training programmes, and community privileges are strictly for your individual use. You are expressly prohibited from sharing your login credentials, distributing proprietary workouts, or granting platform access to any third party. Our server architecture actively monitors simultaneous IP logins. Any account flagged for unauthorised sharing will be permanently terminated without warning or refund. B. Professional Conduct & Anti-Social Behaviour: We operate a zero-tolerance policy for anti-social behaviour, harassment, bullying, hate speech, or the deliberate discouragement of other cohort members. Management reserves the right to immediately revoke community posting privileges or ban any user who introduces toxicity into the ecosystem. C. Media Standards & Explicit Content: Uploading adult, sexually explicit, or inappropriate media is a direct violation of this agreement. Progress photos must be taken in appropriate athletic wear (e.g., standard gym attire, sports bras, or fitted swimwear). Any imagery deemed inappropriate by management will be immediately scrubbed from the server. D. Revocation of Access: Dulson Performance management acts as the sole arbiter of this Code of Conduct. We reserve the right to suspend or permanently revoke your access to the platform and the competition—without refund—should you breach any of these structural rules. 8. INTELLECTUAL PROPERTY - All training programmes, nutritional calculators, operational frameworks, and digital layouts provided within Project 90 are the exclusive intellectual property of Dulson Performance. You are granted a limited, non-exclusive license to use these materials for personal development during the 90-day protocol. You may not copy, reproduce, repackage, or distribute any part of the Project 90 system for commercial use or personal profit. 9. TECHNICAL AVAILABILITY & DISRUPTIONS - Dulson Performance hosts its platform on premium, independent server architecture. While we guarantee high performance, we cannot entirely eliminate the risk of temporary technical disruptions. In the event of scheduled server maintenance or unforeseen technical downtime, you will not be entitled to a refund or compensation. We will ensure any required check-in deadlines are adjusted accordingly to accommodate outages. 10. GOVERNING JURISDICTION - These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
